Environment / water / water permits

Serbia’s Law on Waters regulates the legal status of surface and groundwater, water use, water land and infrastructure, quality protection and protection against harmful water effects. It connects water management planning, administrative acts, user obligations and supervision. A right to use water is different from authorisation for construction or wastewater discharge: one document does not automatically cover every activity at the same location.

Responsibilities are divided among the relevant ministry and Republic Water Directorate, provincial and local authorities and public water management enterprises according to area and activity. Water inspection supervises obligations within its remit. Municipal drinking water supply, watercourse management and assessment of the health safety of drinking water are different functions. Identify the water body, structure and activity before deciding where to address a problem.

If you suspect wastewater discharge, record location, time and visible effects without entering an unsafe area. Request available information on the water permit, discharge conditions, treatment and measurements, then submit a documented report to the appropriate authority. A photograph or smell may justify investigation but does not by itself establish water composition or an operator’s responsibility. Before work near a watercourse, check required water acts together with construction and environmental requirements. Keep responses and distinguish an information request from a complaint or challenge to a specific decision.

The current framework comprises Official Gazette 30/2010, 93/2012, 101/2016, 95/2018 and 95/2018 through another law; the latest listed changes were published on 8 December 2018. The official Legal Information System supplies the current legislation. Directorate documents contain the original and amendments separately, so an older PDF does not demonstrate the whole current law. Relevant implementing regulations also govern particular water acts. This law does not replace emergency action during a flood or separate procedures for compensation.

This is Avangarda’s informative editorial overview and translation, not an official translation.
