Housing / building management and housing support
Serbia’s Law on Housing and Building Maintenance connects residential building management with sustainable housing and housing support. It governs use and maintenance of buildings and their parts, residential communities and managers, records, supervision and certain eviction and relocation procedures. Ownership of a flat and responsibility for common areas are different matters; decisions concerning the building have their own legal framework.
Owners can examine community organisation, decisions, managers’ responsibilities and maintenance costs. Managers and communities have statutory roles beyond informal arrangements among residents. A tenant does not automatically occupy the same position as an owner; contracts and responsibility for use also matter. Construction, property and contractual disputes may involve additional legislation.
Keep community decisions, minutes, management agreements, invoices and records of reported problems. In a maintenance or cost dispute, identify the relevant decision and building part. Check local-government and inspection jurisdiction. Contacting a manager or supervisory authority does not necessarily resolve every private financial dispute or determine a compensation claim.
Housing support is not a universal entitlement to a free flat. Eligibility depends on legislation, the programme and the applicant’s situation. Eviction and relocation involve particular conditions and protection of vulnerable persons. Different procedures, buildings and housing statuses must not be treated identically. Before acting, examine the decision, authority, facts and available remedies, especially where a vulnerable household is involved.
The current series is Official Gazette 104/2016 and 9/2020, change through another law. A complete text hosted by the official Commissariat for Refugees and Migration and newer institutional sources confirm it. A 2023 draft amendment has not been treated as enacted legislation. The source enables checking the law; a particular support programme’s conditions require separate examination.
