Work / protection from workplace harassment

Serbia’s law protects against workplace conduct that, under statutory conditions, harms dignity, health or a person’s position at work. It covers employers’ obligations and protection routes for covered working persons. Patterns, repetition and actual circumstances matter; every conflict or unpleasant incident is not automatically harassment within the statutory meaning.

Employers have prevention and protection duties, but every decision or lawful warning is not harassment. Conversely, formal managerial authority does not justify prohibited conduct. Harassment, discrimination and challenges to dismissal or another decision are different legal issues. They may arise together, but available procedures and conditions differ. Other legislation may govern discrimination and the legality of an employment decision.

Keep a chronology of particular actions and omissions, their repetition and effects. Preserve correspondence, decisions, witness information and relevant medical documents. Distinguish direct knowledge from assumptions. Documentation helps assess internal procedures, mediation and court protection, but does not itself establish the final legal classification.

If the alleged actor is an employer who is a natural person or the responsible person in a legal entity, Article 14 permits a direct court claim without prior internal mediation. Article 22 sets six months from the last act of harassment. Following the internal procedure, Article 29(2) allows a claim within 15 days after service of the specified notification or decision. The Republic Agency for Peaceful Settlement of Labour Disputes also has duties under separate legislation; contacting it is distinct from internal or court proceedings.

The current law was published in Official Gazette 36/2010. The specific official PDF hosted by the Central Registry of Compulsory Social Insurance and current institutional catalogues confirm it. Application began 4 September 2010. The source allows checking the original rules, while this page offers an accessible explanation of protection.
