Law on Primary Education
Regulates primary school organisation, programmes, subjects, pupil progress, examinations and records. It works with the education framework law for enrolment, attendance, support and completion.

Education / primary school / pupil rights
Serbia’s Law on Primary Education regulates school organisation and educational provision, programmes, mandatory and elective subjects, pupils’ position and progress, examinations and records. Internal school rules are not the entire framework: this specific law operates alongside the Law on the Foundations of the Education System and relevant rulebooks. For a particular issue, distinguish teaching arrangements from procedures protecting a pupil’s rights.
Schools and their bodies deliver programmes and maintain appropriate records. The ministry, school administration and inspection services perform their respective functions. Parents or other representatives should check enrolment procedure, documentation and the responsible school. For support needs, seek discussion with the professional service and information about available measures. A need for additional support is not automatically a reason to deny education. Inclusive support rights and procedures should be read within both education laws rather than based solely on a school’s informal explanation.
For a disputed grade, absence, examination or record, gather the subject, class, decision, notice and receipt date. Ask the school a precise question and request the applicable rule. Connect any formal challenge with the relevant framework procedure and deadline. Talking to a teacher and lodging a formal objection are different actions. When changing schools, check transfer of documentation and continuation of education; documents from abroad may require a separate recognition procedure. Do not assume pupils and parents have identical standing in every decision.
The current publication chain comprises Official Gazette 55/2013, 101/2017, 27/2018 through another law, 10/2019, 129/2021, 129/2021 through another law, 92/2023 and 19/2025 of 6 March 2025. Under Article 17, the latest amendment takes effect on the eighth day after publication, without a separate deferred application provision in that act. The official Legal Information System provides the current whole text; parliamentary PDF 319-25 contains only the latest amendment. Also check the current framework law, rulebooks and the particular decision concerning the pupil.
This is Avangarda’s informative editorial overview and translation, not an official translation. For a particular case, check the current law through the official source, relevant implementing rules and individual decisions, and seek qualified legal help where needed. This overview does not replace the legislation or a competent authority’s decision.
