Democracy / political finance / public scrutiny

Serbia’s political financing law regulates money for parties, coalitions and citizen groups, regular operations and campaign expenses, records, reports and control. Public and private funding have distinct requirements, limits and duties. The 2026 amendments also cover third-party campaigns; their statutory position must be checked against the actual activity rather than an organisation’s name. General advocacy and a covered campaign should not be treated as interchangeable without examining the law.

The Agency for Prevention of Corruption supervises financing and reports within its remit. Political entities and responsible persons must track sources, permitted contributions and expenses, while donors check their own restrictions. An account, internal record and published report are different things. Do not assume every form of support has the same regime or that publishing a report establishes the legality of every transaction.

For public scrutiny, compare donations, spending, dates, campaign type and available reports. Establish whether data concerns regular work or particular elections. Submit documented suspicions to the Agency with facts and supporting documents. Residents do not automatically have the controlled entity’s procedural rights; reports, information requests and legal challenges are different actions. Keep sources and replies and avoid alleging illegality solely from an incomplete financial figure.

The law appears in Official Gazette 14/2022 of 7 February 2022, amended by 63/2026 of 10 July 2026. The original takes effect the following day and the amendment on the eighth day. Amendment Article 26 provides 60 days for public authorities’ acts on providing services and goods and publication within 8 days after adoption. Earlier control proceedings have the original law’s transitional regime. Use current Legal Information System legislation and Agency acts; parliamentary PDF 2305-26 is only the latest amendment, not the whole law.
