Migration / asylum / international protection
Serbia’s Law on Asylum and Temporary Protection regulates protection for foreigners needing international protection, decision procedures and rights and duties at different stages. Refuge and subsidiary protection rest on statutory grounds and individual assessment. Temporary protection has a separate regime activated by a government decision. Nationality or accommodation in a reception centre alone does not establish that a particular status has already been granted.
The Asylum Office within the Ministry of Interior decides at first instance; the Asylum Commission is the appeal body. The Commissariat for Refugees and Migration supports accommodation and assistance, which is different from deciding an asylum application. The law provides individual examination, non-return protection in the circumstances it specifies and consideration of vulnerability. Protection grounds and possible limitations must be checked against personal circumstances and the applicable procedure rather than assumed from another person’s outcome.
People seeking protection should explain the reasons for their fear and relevant events, retain documents and clarify their next step with the authority or a qualified legal representative. Expressing an intention and deciding an application are different stages. Raise interpretation, support and special treatment needs in time. Oral information does not establish that protection has been recognised. Following a negative decision, immediately check the remedy information, receipt date and conditions for further action, without assuming one deadline covers every situation. Keep the actual decision accessible for legal assistance.
The law was published in Official Gazette 24/2018 on 26 March 2018, entered into force on 3 April 2018 and applies after 60 days from entry into force. No newer adopted amendment was confirmed in official sources. For temporary protection, also check the current government decision and its coverage. This law is not a general permission for every foreigner to enter, work or stay. Support entitlements and individual decisions must be read with other relevant legislation.
This is Avangarda’s informative editorial overview and translation, not an official translation. For a particular case, check the current law through the official source, relevant implementing rules and individual decisions, and seek qualified legal help where needed. This overview does not replace the legislation or a competent authority’s decision.
