Family rights and child protection

Serbia’s Family Law regulates marriage and divorce, unmarried partnerships, parent–child relations, adoption, fostering, guardianship, maintenance, family property, protection from violence and personal names. Different requests follow different procedures: registrars perform their statutory tasks, the social work centre acts as guardianship authority, and courts determine family disputes. Identifying the requested decision helps establish the proper route.

A decision concerning a child must follow the child’s best interests, rather than automatically favour either parent. A child capable of forming an opinion has a right to express it, with attention appropriate to age and maturity. Children born within and outside marriage have equal rights. Parental rights must not be abused as a means of pressure against the other parent.

For example, a parent seeking arrangements for parental rights and maintenance after separation should describe daily care, schooling, health needs and costs, alongside the parents’ resources. Maintenance depends on the recipient’s needs and the payer’s means. Supply relevant decisions and information, and specify what the court is asked to decide. A social work centre’s opinion is not itself a judicial decision. A separate request for protection from violence should identify the conduct and danger involved.

Distinguish separate from joint property. Property acquired before marriage, by inheritance or gift is generally separate; property acquired through work during married life together is generally joint, subject to a possible different marriage agreement. Divorce does not automatically divide every asset. Without an agreed division, the court determines it. Family-law measures protecting against violence follow their own procedure and differ from police emergency measures under another law.

General application began on 1 July 2005. The verified publication history is 18/2005, 72/2011 through another law, 6/2015 and 109/2025 through the Civil Register Law. The latest publication provides for Article 303 paragraphs 2 and 3 to cease only when the new law begins application, three years after its entry into force. That cessation has not occurred as of 11 October 2026. A draft amendment is not legislation in force.
